under the CGA the seller has to only do one thing.

And I quote" When providing a replacement you are required only to provide goods identical to those originally purchased."

So PB are well within their rights to give you the exact same card, It cant be any lesser in functions but can be better more up to date card, but as mentioned before price doesn't come into it.

1244249 2011-11-18 07:07:00 No problem. But the re-stocking thing is that they cannot restock or charge you for an item that is faulty. I would call it replacing it with something of equal performance.
Because they would then they wouldn't be able to straight up swap the card with gigabyte or whoever. They would have to get the card fixed and then restock it and sell it off as refurbished at a lower price. They would end up losing out.

1244251 2011-11-18 07:15:00 CGA does not offer you a right to a refund. You have the right, if they can't fix the issue in a reasonable time (3-4 weeks would be deemed reasonable), for an item of similar-type - which they are offering you. This is at their discretion, you can't force them to give you a refund if you don't want to (and can repair it). You can get a refund only if they can't fix it or offer a decent replacement.

The 560 is the successor to the 460 - so you are getting a newer product. Prices drop all the time, that doesn't mean you can abuse the CGA to profit from this by getting a refund for last year's prices today and somehow benefit by it, which you seem to be doing, rather than having your problem fixed.

I am not abusing the CGA. I am actually going to get them to send the card back now to get a replacement gigabyte one.

1244253 2011-11-18 07:45:00 You are lucky that they don't send you a refurbished one. Your card is one year old so your replacement card should be a one year old refurbished one. I had my motherboard fail in June this year, 2 months short of its 3 year warranty expiring. It was sent away and replaced with a refurbished one. I was without my computer for 6 weeks. I was more than happy with that.

Crap,I have 2 of them.About a year ago I had those display driver errors popping up all the time then they vanished.
