| 1222445 | 2011-08-11 10:11:00 | I read this about 'a' David Dumolo in the Rotorua Daily Post Friday 10th June 2011. "MAN IN COURT FOR DRUGS IMPORT" A man charged with importing drugs appeared in the Rotorua District Court yesterday before Judge Phillip Cooper. David Dumolo, 39, computer professional is accussed of importing Class drugs on May 23rd last year in Auckland. He is also charged with possession of Class C drugs on August 23 last year in Rotorua. Dumolo was remanded on bail to appear on August 16 for call over. Could it be the same person who stole a DVD?????????? |

He had a couple of warnings and upset another staff member so the next time a ticket was used, it was the final excuse to fire him. He was either badly represented, or not represented at all then. Behaviour condoned in the past, either actively or by default is very weak justification for a dismissal and a skilled advocate could drive a train through that one. Inaction may be said to have turned it into a tacitly condoned 'perk'. As has been suggested, there may be other reasons for the dismissal in the DVD case, and so long as they were for honesty matters (time sheets, extended breaks, skiving off, sick leave when not sick, or any other common rort, AND the employee was taken to task over them, then the employer is on safe ground. The basic premise here is that serious disciplinary action for breaking of rules etc should never come as a surprise to the employee. Fair warning is required for just about everything other than gross negligence or serious misconduct sufficient to justify summary dismissal. A 75 cent DVD is on a par with using the photocopier for personal copying, having several company ballpoint pens at home, or using a couple of the company's envelopes, it is not right, it is dishonest, but it is not a capital offence. I suspect that there was more to this than meets the eye, and if he runs a good defence with a good lawyer, the outcome may just surprise the employer. Cheers Billy 8-{) |
