They did have some mines inspectors (even if only 1 or) and surely with only 2 or 3 underground mines in NZ they should have been able to visit Pike River occasionally, and they should have picked up many of the shortcomings.

1242807 2011-11-11 01:34:00 OSH lol, boy let tail lift of truck down by removing hose to cylinder at same time the driver decided to lay down and have a look under the truck.
The taillift smashed his head into the kerb, squashed up his head some but he survived.
I thought OSH is going to do me, sure enough they rung up and asked for a copy of the invoice or job sheet. I said I did not charge the job.
They said I must give some sort of job number but I said no, different people rung over a month asking the same question. Then one guy told me from the Dept Of Labour said if I did the job for free it was not commercial and an occupation and not covered by the Labour Dept and OSH. He said if cant give us a copy of the job we cant prosecute you. Thanks mate probaly the only decent bugger in OSH you saved me BACON.

Pity they were so incompetent in your case, they should have nailed you. None of what you have said would make it difficult to take action against your company.

Though the story is different each time you tell it, so the creditability factor isn't high.

You’re dead right Digby.

There were only 5 underground mines operative including Pike River when the second Mine Inspector was made redundant through lack of something to do.

Like you, I figure checking five mines for safety a couple of times a year at least shouldn’t be too exhausting for one man.

However, like Paul says, we don’t chase down and prosecute dikshits that work in government departments, oh no, they have immunity. :mad:

I am sure that some of you who criticise the Health and Safety in Employment Act, and the office employed to administer it, which is a part of the Labour Department, are critical just because you think it is fashionable. If you had ever been hurt at work you would see things differently. The responsibility for ensuring a safe workplace depends not solely with the employer, or the Act, but also with you, the employee, and you are probably the most important part of all. Richard (739)

1242815 2011-11-11 03:54:00 The biggest problem OSH and its pedantic rules has is that it flies in the face of Darwin's Law of natural selection. Its just not right to mess with the laws of nature.
