1253913 2012-01-13 20:58:00 Well if you have to respond to an email maybe, but otherwise no one forces you to read an email.

Many IT departments provide 24 x 7 coverage and we have to have someone respond to events as they happen. This is of course why you set up a roster for on call work so only one person has the inconvenience to respond to minor alerts. At our place you get an allowance for being on call whether you get called or not - then you get paid if you have to actually do something to fix a problem.

1253914 2012-01-13 21:06:00 I'm a contractor so it doesn't really affect me - if I do some work, there is an invoice for that time.

I just thought it was an interesting development for permies (in Brazil, at this stage at least) and thought it might generate some discussion on what constitutes work and how much you would have to do to justify overtime (aside from the pre-arranged on-call scenario)....

1253918 2012-01-13 22:22:00 Some people are on a salary rather than being paid by the hours worked. I am paid by the hour and according to my work contract if I am called out on my days off I am entitled to a minimum of three hours. I do occasionally send and receive work related emails on my days off but I do not bother claiming extra wages for this. Quite often people are called at their home phone number when off duty for quick answers to work related questions. I suspect that few people would bother to charge their boss for this. Bobh (5192)
1253919 2012-01-13 22:35:00 What about the other side of the coin, if answering work emails after hours constitutes overtime, does this mean that answering personal emails/ phonecalls during worktime constitues time off? and the employer should be able to deduct payments Morgenmuffel (187)
