1264233 2012-03-12 10:54:00 You do realise what this is all about? The serious crime that was committed??

The owner/manager Huljich put his own money into the investors funds .

Astonishing . What a fraud . Instead of taking money out as a good financial manager would do - Mr Petricovic, Mr Eric Watson, Mr Mark Hotchin, et al . . . no Mr Huljich put his own money in to ensure investors got the return they expected .

And because of that, somebody expects the directors to be prosecuted?? Because the company did what it said it would??

Words fail me .

It has to do with the directors (who also happen to have a political influence in the running of our country) supplying misleading information in a financial document for the purpose of hiding the fact that they had made some bad investments, and denying investors the opportunity to assess their true performance.
I agree that the financial consequences may be small or negligible, and the events are hardly a serious crime, but this goes to the credibility and character of people who hold trusted and influential positions in our government.

Sounds very noble of him if only it wasn't for the fact of trying to hide what poor investments they made. By putting his own money in he hid this fact to get more investment but how long was he going to put his own money in before he pulled the plug and then left investors down the tubes.
eg. he was making it look a far better investment than it was.

1264236 2012-03-12 18:26:00 You give financial companies your money because you get a higher return than an established (150 years at least) bricks and mortar bank.
However when you do this you are risking your money.
Its fear and greed at play so stop whinging when you lose your investment. Sick to death seeing people on TV saying they lost all their retirement money , they cant sleep at night, are sick, suicidal BLA BLA etc. Also breaking rule 2 of investments dont put all your eggs in one basket.
A fool and their money are soon parted.
IF YOU CANT AFFORD TO LOSE THE MONEY PUT IT IN THE BANK.

But if you are getting false information how can you make informed decisions to reduce your risk.
Peter Huljich pleaded guilty and got convicted and fined $112632. John Banks family trust also had shares in the company.
While Banks and Brash may not have known about the cash injection when they signed off on the prospectus they obviously didn't do due diligence. If you put your signature to something you make sure you know what it is about and if you don't that is your fault and should still be held accountable after all Banks and Brash would have carried a bit of weight in investors minds and what do directors get paid for.

mikebartnz has already stated the obvious. When the Huljich Fund was recommended to me it was on the basis that it was consistently out performing other funds. Even before it was known that the manager was pumping his own money in to falsify the returns I was turned off by Brash and Banks being Directors. My rule of thumb is that "celebrity" directors or advertising spokesmen are a warning sign.
