1265532 2012-03-18 06:54:00 Marriage is like a deck of cards - it starts with two hearts and a diamond and ends with a club and a spade ... :)

Get a T-shirt that says:
"If I had killed you when I first wanted too I'd be out by now"
and wear it to all counselling sessions / lawyers meetings.
The idea has merit. Counselling does not work it only prolongs the agony.
Bust the trust its about time the husbands in this country had a win with the courts.

1265533 2012-03-18 08:14:00 www.listener.co.nz situation as both setup and owned the trust, Ali's problem is that he isnt part of his wifes trust.
Effectively, all he and his partner have been doing is paying rent to the landlord, in this case the landlord is the wifes family trust who own the house.

1265534 2012-03-18 09:14:00 Thanks for all of those interesting contributions -- I'll take the T-Shirt idea under advisement ...
The marriage is over given the issues at play now - it's just gotten bloody ugly all round unfortunately.
Going to see a lawyer so I'll let yous know how I get on but from the googling that I've done and a kind hearted Press F1er who has PM'd me it's not looking too promising (damn!).

And to clarify - the trust was originally set up by my wife's parents and my wife along with her father and one of her other sisters are trustees

1265535 2012-03-18 09:47:00 Common sense would say you should get back at least your share based on your contribution, not 50/50 as shared property rules don't apply to a trust, however given that you are not involved in the trust you may be reliant on their goodwill to an extent.
Good luck.
(and I would probably give the T-shirt plan a miss too ... :))

1265536 2012-03-20 07:44:00 Hi All

I spoke to a lawyer today who seemed to think that I should at least be able to get back my initial contribution (i.e. the deposit) despite the fact that the house was brought under the trust so that's made me feel a bit better. Sounds like it might take awhile to resolve so wont be popping out to buy an iPad 3 this week though ....
