39185 2002-03-14 11:08:00 Well bugger.......I went to download Beos...and low and behold they have gone under....I had been using it on one of the computers here.....looks like one less OS on the market....bit of copy and paste from their website, apparently they have filed suite against MS...

We would like to take this opportunity to thank you for the support you've given Be Incorporated over the years.

At the special meeting of stockholders, held on November 12, 2001, Be's stockholders approved the sale of substantially all of its intellectual property and other technology assets to Palm, Inc. and the dissolution of Be through the adoption of a plan of dissolution. Under the asset purchase agreement that closed on November 13, 2001, Be received Palm common stock valued at $11,000,000 and as announced Be sold for cash the Palm shares promptly following the closing. Following the sale of the shares, Be intends to pay all of its outstanding liabilities and obligations in accordance with applicable law and the plan of dissolution. Although there is no guarantee that any assets will remain after the satisfaction of all claims and obligations, any remaining assets would be available for distribution to Be stockholders.

MENLO PARK, Calif. -- February 19, 2002 -- Be Incorporated (NASDAQ:BEOS) announced today it has filed suit against Microsoft Corporation for the destruction of Be's business resulting from the anticompetitive business practices of Microsoft. The lawsuit alleges, among other claims, that Microsoft harmed Be through a series of illegal exclusionary and anticompetitive acts designed to maintain its monopoly in the Intel-compatible PC operating system market and created exclusive dealing arrangements with PC OEMs prohibiting the sale of PCs with multiple preinstalled operating systems. Be has retained the law firm of Susman Godfrey L.L.P. on a contingent fee basis to represent Be and to seek recovery of damages for the benefit of the company and its stockholders. The suit has been filed in the United States District Court in San Francisco. A copy of the complaint will be made available on Be's website at http://www.beincorporated.com

39186 2002-03-14 11:16:00 Well that would probably explain why I couldn't download it the other day. I couldn't find any mention they were closing down, but I sure couldn't find a download link.

PS. Well the GNU OS is coming out soon or something I see on the PC World site.

39187 2002-03-14 21:59:00 It was a great OS its a pitty it lacked apps, its multimedia support was well ahead of windows/mac for quite a while.

The law suit is a bit late to save them but I hope they atleast get a big pile of cash :-).
