| 1293298 | 2012-08-06 06:17:00 | Took 4 days leave. Apparently I lose 5 days off my annual entitlement for that. They calculate it on 8 hrs, 5 days. Never mind my regular shift is 8am to 7:30pm weds to fri and 8:30am to 5:30pm Sat. Always. Every week. Sucks. |

Annual leave is specified in weeks, not hours or days, only the pay varies according to the number of hours or days you work. Ministry of Business, Innovation and Employment: All employees are entitled to at least four weeks’ paid holidays a year. Employees get their annual holiday entitlements on their first and subsequent anniversaries after starting work. Some agreements may provide for one or more “additional” weeks of holidays on top of the statutory entitlement. Annual holidays can be taken at any time agreed between the employer and the employee. Employees must be given the opportunity to take at least two of the four weeks’ holidays continuously, if they wish to do so. A week is seven days and regardless of what hours a day you work, or how many days, you get Weeks of Holiday. I suggest that you either talk to the MoBIE for clarification, or print out the relevant section of the Act and give it to your employer. If they are doing as you say, they are almost certainly breaching the law, and you cannot contract out via an employment contract, though there is a little bit of mutual agreement 'wriggle room'. If I have misunderstood your post, or you are an independent contractor (self employed) please excuse me, but it sounds to me like you are getting rorted. 40 hours in 4 days makes no difference.
