Well I have legal knowledge and information security knowledge, so can i speak my mind or should i be supressed as you have tried to do to loshing?

Your legal obligations are that you must pay under the T&C of the contract. No matter that you didn't read them, unless you can claim that it wasn't actually you that attempted to use this service.
Yes indeed the route you took to gain access to this service is not even hacking at all, more like trying to find out where the line in the sand is, the problem is you stepped over the line, so now you must pay.

Once burnt, twice shy.

So not only have you learnt not to do this again, but it also sends a message to other PressF1 users not to toy around with controls in place.

100433 2002-11-23 23:45:00 If you read with your eyeballs properly, there was no T&C, and I din't click on anything saying that I agree to them.

ALL I CLICKED WAS A "SEND ME A DIRECT DEBIT FORM"

Geeze some people youd think was deaf around here...

If you requested a direct debit form, did you not make a connection between the said form and MONEY? If you are asking for a direct debit form, you can expect to be paying for something.

Geez, sounds like some people are stupid around here....

So you clicked that button and it miraculously configured your DUN settings to dial-up to Orcon and it dialed up and stayed connected all with out you having to do anything other than click "SEND ME A DIRECT DEBIT FORM"

Seems a bit far fetched to me :)

100439 2002-11-24 01:17:00 Sik,

If you're not willing to listen to the advice or comments (all of them reasonable, really), then why do you come to a forum, asking for "small legal advice"?

What Lohsing and roofus have said is perfectly reasonable, why don't you take what they have to say onboard, rather than beating them about the head (metaphorically)...

Next time you have a problem they may be less keen to help you out.

100440 2002-11-24 02:51:00 The problem seems to be that having asked for "advice" (really opinions), he doesn't like the answers. I don't think he would like the answer he would get from a lawyer too. ;-)

BTW, driving up a private driveway to "see how far you can get" would not be considered a "lawful purpose" to be on private property. That is trespass.

100441 2002-11-24 03:02:00 I can't belive what i fell over when i was at orcon: terms and conditions (www.orcon.net.nz)

Heres some exerts:

Notes to the Terms and Conditions
IF YOU DO NOT AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS AT ANY TIME YOU MUST IMMEDIATELY CEASE USE OF THE SERVICES and must send notice of account cancellation in writing to the ISP. The user remains liable for any applicable charges incurred to that time. No penalty will apply to such cancellations except as otherwise specified in these Terms and Conditions.

Subscriptions and Termination
Either party may terminate the contract upon the supply of one month written notice.

What can't you understand about this Sik. This was made avaliable to you when you first joined up to orcon. They don't need to wave the T&C in front of your face each time you do something on the internet you know!

This contract is valid from the time it is entered into, to when it is mutually terminated by both parties. Your actions are within the time of this contract therefore you are liable for 1 months worth of services.
