Backing up the Software YOU PAID FOR!!!

The below was found on MY original copies of software I have. I found these by inserting the disk in the CDRom drive and search for "EULA" on the drive.
These do not represent ALL software I have. I was prompted to make this post because earlier there was a thread which is now locked about backing up a game. Various people jumped in like Crozier and basically said that it was illegal in New Zealand to make a BACKUP copy of software.

I am here to tell you PressF1 people that that is not ALWAYS the case.

A few examples are below and I invite your comments. IMHO you very often can buy the software which gives YOU a license to use it. It does NOT give you a license to copy it by whatever method then sell it or give it to a mate! Normally you get a license to run it on one Computer at a time only, but there ARE exceptions.

You may:
A. use one copy of the Software on a single computer. If a License Module accompanies, precedes, or follows this license, You may make that number of copies of the Software licensed to You by Symantec as provided in Your License Module. Your License Module shall constitute proof of Your right to make such copies.
B. make one copy of the Software for archival purposes, or copy the Software onto the hard disk of Your computer and retain the original for archival purposes;
C. use the Software on a network, provided that You have a licensed copy of the Software for each computer that can access the Software over that network;
D. after written notice to Symantec, transfer the Software on a permanent basis to another person or entity, provided that You retain no copies of the Software and the transferee agrees to the terms of this license; and
E. use the Software in accordance with any additional permitted uses set forth in Section 9, below.

OK ? . Looking at the above I feel I can make a BACKUP copy of the software for my own use only. If I don't want to use it anymore I sell it and get rid of ALL copies.

You may install, use, access, display, run, or otherwise interact with ("RUN") one copy of the SOFTWARE PRODUCT, or any prior version for the same operating system, on a single computer, (COMPUTER). If not prevented by copy protection technology, the primary user of the COMPUTER on which the SOFTWARE PRODUCT is installed may make a second copy for his or her exclusive use on a portable computer.
? Storage/Network Use. If not prevented by copy protection technology, you may also store or install a copy of the SOFTWARE PRODUCT on a storage device, such as a network server, used only to RUN the SOFTWARE PRODUCT on your other COMPUTERS over an internal network; however, you must acquire and dedicate a license for each separate COMPUTER on which the SOFTWARE PRODUCT is RUN from the storage device. A license for the SOFTWARE PRODUCT may not be shared or used concurrently on different COMPUTERS.

Here we get something a little different:- "If NOT prevented by copy protection technology etc ? "
Here is where CloneCD comes in.
I ? m not prevented from making a copy!!!

Here I can make a BACKUP of the Operating system but can't run it on two computers. Sounds OK to me!!!

A: The End User License Agreements for many Microsoft application products contain the following sentence in the grant of license section: "The primary user of the computer on which the Software Product is installed may make a second copy for his or her exclusive user on a portable computer." If your EULA does NOT contain this sentence, then you may only make a copy of the programme for backup purposes only.

Note here that very often you can not ONLY make a BACKUP but you can also use the same copy at home as opposed to work.

To Crozier and others ? . The link above is a New Zealand site.
I remember getting Microsoft Flight Sim Ver 1.0. That EULA said make a BACKUP copy of this floppy disk and install from the BACKUP. I was in Australia at the time though and that may make a difference.

Normally software licenses are like a book. You go buy a book. You read it. You can then give it to someone else. You and they can ? t read it at the same time. Does this make sense ?

Backing up software is fine, normally, as long as it is only used if something goes wrong. If someone said otherwise, they were ill-informed.

However, copy protection often means that a backup is useless. A ghost image of a hard disk with the software installed is often the only option.

Not exactly so Roofus.

That other thread was about getting a program to disable the copy protect.
Not Clone.

If we're going to be pedantic about it, the other thread was about backing up a scratched disc . Not done by disabling copy protection, but through cloning the disc .

There was no discussion on the illegal re-selling or distribution of the material.

Your comments are ill-informed, and I would suggest you re-read the post carefully before posting a sarcastic response which serves only to highlight your inability to comprehend a perfectly valid discussion.

There is no way I condone piracy. I'm just saying that you can backup programs you have paid for.
