1336111 2013-04-09 06:20:00 So that means I can bring home a OEM copy from any random shop singly and install it on my fully assembled computer system? Where does it say I need to buy the computer or parts at the same time or at any shop with the OEM? As chill said its a bit of a grey area, but if you wanted to go by the actual Wording in that FAQ link under the System Builder Licencing, the very first question / Answer is:

The current OEM System Builder License allows system builders to distribute Windows desktop operating system licenses in the following ways:
Preinstalled on a new PC.
Unopened OEM System Builder packs can be distributed to other system builders by themselves. Note that they must remain unopened so the receiving system builder can accept and be bound by the break-the-seal license agreement that is affixed to the pack

That being said theres nothing stopping anyone purchasing parts from various places and buying software as well. The "grey Area" is actually where it says preinstalled on a NEW PC.

As Chill linked many places sell OEM without purchasing complete parts for a whole PC.

And if you look under their own FAQ ( PBTech) relating to OEM they state
OEM stands for Original Equipment Manufacturer, these products usually come without any extras that normally come with the retail package. OEM products are only available for purchase with a computer system. But I spouse they would still sell it without one - Dont know as I buy wholesale from the MS distributors.

As mentioned read the MS FAQ, its all there.

- Don't use the cracked one, get an official one through any means necessary coz it's not worth the potential risks
- OEM is cheaper than retail, but you can only "legally" buy it and use it when you build the PC

The install / Software may be perfectly fine, but Having a pirated licence means sooner or later it will bite you on the ass.

Best to start from fresh install then you know its clean.

Just need to install it, download and install any drivers and away you go.

1336114 2013-04-09 08:36:00 A lot of computer retailers sell OEM versions of Windows 7 without having to buy a computer off them. Check out Computer Lounge and Ascents websites.

If MS wants to make licensing rules so damn murky, complicated, ambiguous & ever changing then they reap what they sow.
Ive had many an argument with customers about licensing rights, Im sick of of it.
Even the Wholesalers often get it wrong, retailers (toaster shops) almost allways get it wrong or just lie to make the sale: (eg how many machines office can be installed on)

1336119 2013-04-09 22:55:00 They've loosened up the rules a lot with OEM windows 8, basically allowing you to transfer the licence between PCs now providing it's removed from the old machine. I also see on the page that was linked a question and answer saying it's ok to buy and install OEM windows on a second hand machine, not sure if that's for all versions though. dugimodo (138)
