to me that xtra still can use/do what they like with your
"customer material" if you place it on their websites or systems.
they can use it but dont own it?
is this correct?

This is from the xtra contract:

"...Our use of your intellectual property


Xtra does not claim ownership of any
content or material you provide or
make available through the Services
("Customer Material"). However, by
placing any Customer Material on our
Websites or Systems (including posting
messages, uploading files, importing data
or engaging in any other form of
communication), you grant to Xtra a
perpetual, royalty-free, non-exclusive
irrevocable, unrestricted, worldwide
licence to do the following in respect
of the Customer Materials:

use, copy, sublicence, redistribute,
adapt, transmit, publish, delete, edit
and/or broadcast, publicly perform or
display, and sublicence to any third parties the
unrestricted right to exercise any of the rights granted,
in each case for the limited purposes
for which you provided or made the Customer Materials available
or to enable us
and our suppliers to provide the Services. "

By putting something on the web, you are to all intents and purposes broadcasting it to the world, and in todays Internet environment, this has to be done under the assumption that it is GOING to be copied and distributed beyond the channel of your specific web server . Therefor this clause simply gives Xtra the legal right to do what is being done by others already .

The only time you would care, would be if you had sensative information stored with Xtra . This would hopefully be with a VPN agreement, as only a fool would publish their own sensative data openly on the web .

Unless the same clause is also in Xtra's VPN agreements, the only ones that would need to be worried about the clause, are the ones that arent bound by it .

this means that you give them the rights to copy your stuff to get it to the job done. and "....limited purposes" not for any other purposes.

as per standard copyright /IP rights they cant copy or ditrobute any thing with out your approvial.

try sending an email with out transmitting or copying data??

if they dident have this in the contract then you would be the first to try and sue them!
