168554 2003-08-20 11:01:00 The whole point is that certain people have been living off the fat of the land and it`s not the vast majority of artists, and as our islamic friend points out, these lardies are the ones waving legal documents at people they think they can bully--including artists. These people make CD`s for very little, including royalties, and the bulk of the price goes to very questionable areas such as hangers on, parties, substances, Cayman Island bank accounts, etc. etc. It`s an international business much like baked beans but with less taste. Watch out for the next Bush war on cocaine-- C.D.`s will rise in price. brewer (4389)
168555 2003-08-20 23:08:00 I got hold of APRA NZ and this was their response:

Music writers have certain rights under the Copyright Act 1994 in New
Zealand.
These rights include the exclusive right to copy or publicly perform their
works. Thereore you are not able to download (copy) a song from the
internet without a licence/permission nor are you able to publicly perform
a song (and in the workplace is in public).
Yes both the situations that you describe are copyright infringements. You
can obviously stream radio if it is in private but if it is not in private
and is in public then you need a licence.
Hope that helps. You can download licence from the web site for music in
the workplace or background music.

The Licence for workplace is an annual fee of $57.00 min per year.
For music on hold 1-20 lines a min of $71.00.

168556 2003-08-21 00:19:00 Why is there a difference between 'workplace' and 'on hold'?? That's nuts!!

And what if you are playing music in your workplace for your personal pleasure, and not your customers?? Surely one has the right to listen to music for their personal pleasure wherever they are, not just at home.

168557 2003-08-21 00:26:00 hear, hear, i agree with antmannz, but i can see why a band like Metallica would get pissed off, but my band would appreciate millions of people rippin' our music dotcommander (4338)
168558 2003-08-21 00:36:00 you can have music playing in your work place (without paying the fee) IF customers cannot hear it eg in the back, storeroom etc tweak'e (174)
168559 2003-08-21 00:38:00 This is from APRA's site today ( . apra . com . au/Copy/CpyNet . htm" target="_blank">www . apra . com . au)

APRA is currently:

* developing new licence schemes for users of music who now require a licence - this includes music-on-hold, digital downloads and Internet radio services (both stand-alone and simulcasts);
* developing a code of practice with other collecting societies and the Internet industry to provide clear procedures for dealing with third-party copyright infringements; and
* factoring the statutory retransmission right into the new pay-television licence scheme .

APRA has employed an Online Licensing Manager to assist in the licensing of online music services .

. . . I myself wasn't aware that the radio played to everyone at work had to be licensed! Our office isn't public in the sense we have Joe Bloggs come in off the street (we don't even take calls from the public) but we still have to pay to play the radio to everyone?? That's ridiculous . Even if I was in a band I wouldn't expect money from companies/offices to pay me for listening to my song on the radio while they work .

168560 2003-08-21 01:09:00 Watch out for the new Surcharge on Vehicle Registration, that is to cover
those who drive through town with their windows down and radio/CD
player turned up!

Govt's next priority after "fart tax" legislation is sorted!

Cheers,Kiwitas,;-)

168561 2003-08-21 01:13:00 If a band like Metallica is getting pissed, then to hell with them, I say.

Musicians are supposed to be artists; and I thought artists were supposed to be people who are creative and not in it to see how much cash they can fleece from people. There are plenty of other musicians who would love to have their music heard for less than half of what those guys have earned.
