Surely all they'd have to prove is that you are offering it for free upload, by having it in your Kazaa folder. Never mind where you got it originally, you could have paid for it fair and square, but you are surely breaching copyright by allowing others to download it.

It isnt so much an alternative release by the makers of kazzaa but a version that has been hacked by users.
