Jen and GF have pointed out that your statement was defamatory. I probably would have, if they hadn't. ;-) Defamation is a legal term, but the essence would be "tending to bring into contempt or disrepute". If someone bothered to sue you, you would have to prove your statements. It would not be for them to prove any loss. You can be found. "probably" doesn't give you any wriggle room in that staetment. "logical conclusions"should be drawn with great care. Arithmetic does not "assume" any radix. Files tend to contain information. The units used for size measurement vary. Advertising tends to contain "convenient approximations". ;-) The basic thing about speed measurements on the Internet is that it is a real time system. That means that there is never ever exactly the same conditions again. So any measurements must be treated as indications, not as "facts". Fighting over a factor of 1.02 is nonsense. |

I made 2 other points as well, the main one being that the "500kb" you are downloading is actually only 492kb, and is compressable to 42kb. |

Don't be so flippant or dismissive about your defamatory statements, if you get taken to task for them it will cost you big, and even if you have limited funds, it will swallow those anyway. Just consulting a lawyer and getting him or her to bail you out on the grounds of diminished responsibility will have you selling off your prized possessions to pay the bill. Don't be jerk all your life, try deep breathing for a while instead of spreading your angst through your keyboard. | 232098 | 2004-04-26 07:17:00 | i think that the 1.02 factor is so small that most of us dont care. the 492Kb Vs 500Kb is bugger all. the compressable thing is a big point. when the math is based on 500Kb and your system is only downloading 42Kb then the numbers will be off by lots. |

Are you suggesting that responsibility is actualy diminished in this particular case or are you saying it would be a handy defence that might just work while your lawyer hoovers your wallet for you. Well Murray, I was originally suggesting that a plea of diminished responsibility (SBITAAB) might have bought the sympathy vote and got the poor lad off with a caution (plus hoovering costs of course) however recent events have confirmed that in this case it would probably constitute a confession rather than a plea in mitigation.
