| 232721 | 2004-04-29 11:59:00 | I agree, sometimes it's not easy understanding what card is what, and which is better, (I'm sure no one really does, and then it changes by the end of the week). There are three cards on your linked page. I assume yours is GC-R9600PRO-C3, not the GC-R9600PROU-C3 Xtreme Edition, or the GC-R9600-PRO C3 Encore Edition. To tell, it is written on the top toward the right on the card. From memory. Perhaps you brought something, wanting something else? Anyways you look at it, it's a damn mess to look at. |

From the GeCube web page all it says about the Encore edition is that it is - non-game bundled, - has a fan(!) and 128MB of memory, and - Supports CRT/DVI/TV multiple display configuration. If it had said, oh and BTW the memory is only 5ns, then I would have bought a different card! |

| 232723 | 2004-04-29 23:16:00 | If you believe that you have been duped in buying a card then you have a claim under the Fair Trading Act against the: (i) vendor of the card; and (ii) the manufacturer of the card. (If the manufacturer is located overseas, you can have an action against the importer of the card.) This action can be brought about under the premise that the vendor has engaged in deceptive and misleading conduct. From what you say, the card does not conform with the description given. If so, there can be yet another claim under the Fair Trading Act for the product not corresponding with the description. There may also be a claim under the Sale of Goods Act, but retailers can opt out of this (unlike the Fair Trading Act). The above comments are provided without any liability to the writer. Best bet - go to the retailer and discuss it. If the retailer does not wish to reach an amicable resolution (usually a replacement or a refund), then let us know. Good luck tutaekuri. |

I have tried to get the retailer to make good what I perceive to be misrepresentation but he doesn't believe he has done anything wrong so I have passed the matter on to the commerce commission who are investigating. | 232725 | 2004-05-13 09:09:00 | Well, the Commerce Commission and I have exchanged a series of emails and to cut a long story short their conclusion is that '(t)he advertisement of the ATI Radeon 9600 PRO at www.pcgear.co.nz clearly states under Specification "u Design based on ATI Radeon 9600 PRO technology with 400Mhz core clock speed". The product and specifications that you have paid for and received is what is advertised for sale by PC Gear. Therefore, there does not appear to be a breach of the Fair Trading Act in regards to misleading or false advertising.' I don't agree but I guess I might have to accept it. I still think it is misleading to pass a video card off as a 'Radeon 9600 pro' even though its memory is significantly slower than the reference design. But worse than that, I think it is downright dishonest not to mention such a difference in your advertising. |

Would it make any difference if you could get a faster one? I suspect you just didn't get the bargin you thought you were getting....... |

| 232728 | 2004-05-16 09:43:00 | Sure, for that price I wasn't expecting the fastest card off the block and didn't expect any extras - but 5ns ram is only good for 200MHz x2 (for ddr) = 400MHz and that alters the performance per dollar dramatically. Its not that it won't play the games I want - it just does it at significantly slower frame rates. Kiki - you can't push the memory faster than its rating unless the manufacturer is generous (and most ain't). The Xtreme version comes with 2.5ns ram, which is theoretically twice as fast. |
