1340188 2013-05-08 00:58:00 Hi there.

It seems Wilson Parking has started issuing parking tickets in their carparks, fining people for overparking. I was stung $65 for going 45 minutes over the time I pre-paid for.
There was the receipt/ticket visable inside , so they could see I had originally paid, but went over time paid for.
Yep, my bad, I made a mistake & lost track of the time (pre-occupied on the job at a clients). I cant see how they can justify a $65 charge (fine)

Has anyone here actually challenged these 'fines' ??
It seems the legality is in question, but Wilson parking threatens to send it to Debt Collectors & clamp next time I use their carparks if that fine isnt paid

1340189 2013-05-08 01:10:00 Are you 100% positive the receipt/ticket was visable ??

if so you have a case of wrongful charges for over parking .

According to Their website: . wilsonparking . co . nz/go/footer/terms-and-conditions" target="_blank">www . wilsonparking . co . nz

Under "PAYMENT AND BREACH OF THESE CONDITIONS" Number 4a

a . Your vehicle does not display a current valid window pass or prepaid ticket so that the date and expiry time are clearly visible, you agree you are parked unlawfully and we may issue a breach notice ("the notice") requiring you to pay within 21 days, $65 . 00 costs of enforcing the conditions of this carpark .

BUT if it was there, further down under "PAYMENT AND BREACH OF THESE CONDITIONS" To people entering this carpark Number 3a
a . You are parked in a parking bay longer than the time stipulated and/or otherwise in breach of the above conditions, you agree you are parking unlawfully and without authority and we may issue a notice requiring you to pay within 21 days $30 . 00 costs of enforcing the conditions of this carpark .

It should have only been a $30 fine .

Guess its upto you to prove the receipt/ticket was actually visible .

1340190 2013-05-08 01:23:00 Add to above - my time ran out ( maybe I should be fined for not editing fast enough) :p

Dont know what the fine actually says, BUT if it mentions anything about being over / exceeding the paid amount of time eg 45 Minutes, then thats proof it was actually visible other wish how would they know how long over you were.

1340191 2013-05-08 01:37:00 Before you pay a 'fine' imposed by a private organisation, I would see what your rights are via the CAB or similar.

As far as I am aware, only court-authorised entities can issue 'fines' for alleged parking offences...

It may be that you can raise the one-finger salute to Wilson's Parking - but of course it may mean you will need to use other parking service suppliers in future, in case they try to clamp you (which may also be illegal).

1340192 2013-05-08 01:58:00 I won't use "prepay" parking building only post paid ones for this reason .. paulw (1826)
1340193 2013-05-08 02:07:00 They're getting harder to find though Paul. johcar (6283)
1340194 2013-05-08 03:27:00 I love the system we have for parking here in Whangarei.
Visit the website on your smartphone and enter in the Zone that you are parked in and how long you want to park for.
You have to have an account created and have some credit available on that account. You enter in license plate and car make/model & colour when creating an account.
Walk away and when your time is about to run out, 10 mins left I think, you get a reminder on your phone and you can top up from there if you need more time, no need to go back to the car and feed a machine.

That sounds awesome - really switched on!

Unfortunately, Auckland Transport have even had difficulty in launching the HOP card (the SnapperCard clone which is working flawlessly in Wellington), so it is clear that anything technological is way out of their league.

Paying for Pay and Display parking via TXT is about as good as they are capable of achieving with technology... Maybe sometime in the next 50 years...

Sounds like a good scheme. How many times do we put coins into a parking meter only to find that you find that you have underestimated the time you will be away or you simply forget to watch the time. The ten minute reminder is good.

1340197 2013-05-08 06:24:00 Now with cellphone payments all that is needed is for your cars security system to alert you when someone is near the car, and at that point pay for 10mins parking, on the assumption it may be a parking warden. Paul.Cov (425)
