278469 2004-10-05 22:22:00 It's personal information as to whether someones account is still active or not, or whether they check their e-mail address or not.

If they were to give it out to you they should be dealt to severely for breach of privacy (and most probably their terms and conditions).

Employ a debt collection firm, thats what they are there for, or look them up in the phone book.

E-mail shouldn't generally be used for this kind of thing.

4.10.1 Timing





Under art 15(2) of the Model Law, the time of receipt of an electronically generated message is:





(a) the time at which the message entered the designated information system of the recipient; or





(b) if there is no designated system, the time of retrieval of the message; or





(c) if there is no designated information, when it enters an information system of the addressee.





Although ECom 2 favoured abolition of the postal acceptance rule (which would mean the time of sending was irrelevant), in substance it favoured using art 15(2) to determine the time both of dispatch and receipt.





Anything wrong with a normal letter or courier?

Absolutely nothing Winston, but the majority of our correspondence has always been by email . In due course all normal paper-based processes will be followed, culminating no doubt in the Disputes Tribunal .

I know how to use that system, and have some experience from my own personal involvement and from assisting others, however, I am establishing particular aspects of the dispute at present and prefer to keep my powder dry until the day of reckoning .

It doesn't help his case if various communications and attempts to resolve the issue fall on deaf ears (or into a black hole full of unopened emails), unconsummated Electronic Transactions Bill notwithstanding .

Weakens his argument . :D

The much disliked MSGTAG will tell you if the message is opened. Just out of curiosity it might be worth downloading the free version for this transaction and then dumping it afterwards.

It will fail if:

A firewall is correctly set up on the recipients PC or server
or
The recipients email client is set to plain text only (quite common) or one that blocks external HTML images (very common)
or
They use Mailwasher and do not download the email.

There's other freebies out there, readnotify.com, which looks suprisingly like mailtracking.com

Always a further option to the previously suggested I guess :-)
