The system has to apply them as they are not as they would like them to be so any blame as to why this individual was still out rests with Parliament which has a definate policy of keeping people out of jail. Under our system you cannot punish someone for what you think they are thinking they have to actually do something first. It would have been a lot cheaper to lock him up rather than follow him around 24 hours a day. Even better would have been to have deported him but then the goverment does not do things like that quite the reverse, they seem to collect as many shady refuges as possible and house them in preference to actual New Zealanders.
