I was thinking a 1/4 ton piece of kit was a bit heavy to cart around on the off chance that he will turn up.
Note I will be in a diff island in 2 months.

I must differ here, pctek. The guy has paid for the item and is the legal owner of it. It cannot be disposed of without the approval of the owner.

There is no lien applicable here as with an item repaired and either left or not paid for.

I think Cic is bound to give the buyer due notice of his intentions to dispose of the item (re-auction it). Until due notice is given and the stipulated date has been passed, then Cic' hands are tied.

At which stage, a refund (less handling fee + any loss against the original amount) can be offered, again with a stipulated date of expiry.

1364079 2014-01-03 07:43:00 I would say it is not unlike people who don't collect their PCs when repaired.

I had one like that, he bought it in, quoted, he accepted, fixed it, he never came back.
Left messages and got hold of a relative of his too and spoke with him. Still nothing.
So I followed the law, placed an ad and then sold the PC to recover costs.


You have contacted this guy several times, TM has too, so sell it again, place bad feedback and move on.

The difference with Ciceros' situation is that the buyer has paid, therefore owns the item concerned ... in your case, they didn't pay and you have a right to mitigate your loss, i.e. parts & labour.

Legally, there's a bloody big difference. If Cicero sells the item again he could be in deep dodo as he's actually sold something that he doesn't OWN, even though he has POSSESSION of it.

Check with your local CAB. I'm inclined to think you may need to place a small ad in the local throw away rag to that effect. That should ensure you are covered in the event you abandon the item. :2cents:

He HAS!!! The guys is not responding to either Trademe or Cic . . . . . . he is not obligated to chase the useless guy forever .
