Having purchased the buzzer,he asked if he could delay pick for a week or two due to having a baby Demand proof he was able to have a baby. Where exactly does it emerge from? Just send him one more email stating if it is not collected in x days, you will re-sell it. Then do so, regardless if he doesn't reply. |

Although you have possession of the machine, I think that ownership has transferred to the purchaser having paid you for it ... In fact, I think it actually changed when both of you agreed to the "contract" to buy & sell. It's been a long time since I did my contractual law studies, but I would be checking with someone who is more up to date with the legislation now. Worst case scenario, you could be done for theft. If you have his address, get it delivered and get the freight company to bill him ... it may be difficult to find a company willing to do that these days, and there may be reasons other than having a baby which has delayed him picking it up, i.e. Death, jail, dun a runa ! My advice would be to check the legal situation (not just layman's theories and opinions) before doing anything. No disrespect to those who have already done so. There's probably a Community Law Center close to you that will be able to give you the right information at no cost. |

It's been a long time since I did my contractual law studies I agree with SP8's; at a base level, there are three components of a contract ... 1) an offer (the bid on TM); 2) acceptance (the advice of the successful bid); and 3) satisfaction (the pregnant one paid the account :lol:). On the face of it the bidder is the legal owner but the item is still in your possession. And that's where it gets a little curly, possession being 9/10 of the law ... My advice would be to check the legal situation (not just layman's theories and opinions) before doing anything. No disrespect to those who have already done so. I had one like that, he bought it in, quoted, he accepted, fixed it, he never came back. Left messages and got hold of a relative of his too and spoke with him. Still nothing. So I followed the law, placed an ad and then sold the PC to recover costs. You have contacted this guy several times, TM has too, so sell it again, place bad feedback and move on. |
