326136 2005-02-18 23:56:00 Oh yes it is the point ninja, 48 hours is quite long enough for an incomplete retail package. The correct response on initial notification was:

"Bring it back in and we'll swap it" or "we'll order another and call you whan it arrives."That was the response they gave - "we'll order another and call you when it arrives" or did you not read the thread?

And as I've said repeatedly, we don't know why they haven't called back - perhaps the phone number was recorded wrong, perhaps they are a one man band and had a death in the family, it could be absolutely anything.

I guess I forgot about the Billy T is always right clause in the rules - why don't you accept someone else providing an acceptable and plausible scenario?

BTW, where did you find this sudden effusion of patience & tolerance? ;)When did you stop being condescending and sanctimonious. Oh wait, my bad.

If you can find your quote (above) anywhere in the first or second thread by ScaredEye and I will post an apology to you.

I repeat, 48 hours is enough time in the circumstances, and you can make all the hypothetical excuses you like, their obligations are very clear.

How about leaving out the personal attacks too. Whatever your personal issues are, don't take them out on me. I'm trying to help the guy, not waste my time getting involved in personal slanging matches.

OK then champ :thumbs: I was quoting you, however they did say they would contact him within two working days.

First post in the thread:

I bought a ASUS A8N-SLI Delux, but I didnt recieve a backplaye with it[Saturday the 12th]. When I went to the shop the next day, they promised they would call me by Tuesday[15th]. I havent gotten a call so far. I want to know if there is anything I could do to get the hardware I paied
Timeline:

Saturday 12th: Purchased hardware
Sunday 13th: Returned hardware with missing part - on this day the shop said they would call on the 15th. This is less than 2 working days from the time the fault was reported.
Tuesday 15th: Failed to call customer as agreed
Friday 18th: Customer elects to post a thread here rather than calling the store as logic would present - lots of people provide legal standpoints and other ideas - very few provide logic like actually calling them.

You can say and think what you like, and I'll just wait and see what the outcome is for ScaredEye, he's the person who is asking for help and doesn't need a sideshow. His problem lies within my areas of business expertise, which is why I offered advice in the first place.

Billy - your comments directed at ninja's about his quote "sudden effusion of patience & tolerance" was uncalled for and designed to get a response which then started the rest of it off .

Both of you leave it alone or you both will end out in the cold for 24 hours again . Don't care who started it first, it is your choice to join in instead of just ignoring him .

After about 20mins I hung up. I tried to call the back, and when they picked up, I said I had just called, and they hung up on me. Then I called for a third time, this time they spoke chinese or something, and hung up. Their phone has been engaged since. I think now is the time to use CGA... ScaredEye (7358)

It might also be time to name the shop in question so that the rest of us don't have a similar experience.

326145 2005-02-19 20:24:00 OK ScaredEye, this is the process .

Write up a log of everything that has happened so far so that you don't lose track of any details, especially times and dates . Make clear copies of all paperwork, receipts etc .

Pack up the board, along with all paperwork and take it back to the shop . Ask for the Manager and explain the problem . Keep it cool and polite, getting angry or abusive gives them an excuse to tell you to leave .

Do not surrender possession of the board itself unless you are given a replacement . Do not accept a substitute without first making sure it is at least equivalent to what you first selected .

Make it very clear that you want either a replacement board there and then or a full refund . If you strike language difficulties, real or feigned, find the person who spoke to you originally or anybody else in the shop that you have heard speaking reasonable english .

Be persistent, don't leave the shop, keep asking for your money back in a calm but positive manner . It will do no harm if the shop is busy and other customers hear your difficulties .

Do not threaten them with CGA action, just tell them that the CGA is a NZ law that entitles you to your money back if they can't fix the problem .

Be prepared to have to go to the Disputes Tribunal if necessary, but don't be surprised if fronting up sorts it all out .

If you are a minor, take an adult with you .

Patience, persistence, politeness .
