Longer answer: It depends on what the torrent is of that makes it legal/illegal. Latest starwars movie? Not legal! Slackware Linux? Yes!

But wouldn't that be with the programs that they own the copyrights to?

I think that is a completely different thing to Joe Bloggs recording and distributing a program when he doesn't own the copyright
